Neurosurgery for psychiatric disorders, also sometimes referred to as psychosurgery, is rapidly evolving, with new techniques and indications being investigated actively. Many within the field have suggested that some form of guidelines or regulations are needed to help ensure that a promising field develops safely. Multiple countries have enacted specific laws regulating NPD. This article reviews NPD-specific laws drawn from North and South America, Asia and Europe, in order to identify the typical form and contents of these laws and to (...)

When Not Knowing is a Virtue: A Business Ethics Perspective.Joanna Crossman & Vijayta Doshi - 2015 - Journal of Business Ethics 131 (1):1-8.
How leaders and managers respond to not knowing is highly relevant given the complex, ambiguous, and chaotic business environment of the twenty-first century. Drawing on the literature from a variety of disciplines, the paper explores the dominant, unfavorable conceptualization of not knowing. The authors present some potential ethical implications of a negative view of not knowing and suggest how organizations would benefit from identifying any unhelpful aspects of the culture that may encourage unethical, undesirable, and/or hasty actions in situations of (...)

Background and rationale Several factors that motivate individuals to participate in non-therapeutic studies have been identified. This study was conducted as limited data is available regarding these motivations from developing countries. Methods This was a single-centre study conducted over 4 months in which a questionnaire was administered to 102 healthy participants and 16 patient participants who had earlier taken part in non-therapeutic studies at our centre. Descriptive statistics and univariate analysis were used to analyse data. Results The most common motivation (...)

Using the Bass Model to Analyze the Diffusion of Innovations at the Base of the Pyramid.Kokila Doshi & Ryan Ratcliff - 2016 - Business and Society 55 (2):271-298.
This research note proposes the Bass Model as an empirical tool for analyzing the diffusion of new product and service innovations in Base of the Pyramid markets. This approach allows researchers to test whether factors that seem theoretically relevant to the speed and trajectory of adoption actually matter empirically. The authors model the growth of three BoP success stories using the Bass Model: Patrimonio Hoy, e-Choupal, and Grameen’s Village Phone. In two of the three cases considered, the Bass Model estimates (...)

A Decade of Change: A Case for Global Morality, Dialogue and Transnational Trust-Building.Paresh Kathrani - 2009 - Jurisprudencija: Mokslo darbu žurnalas 118 (4):97-104.
The world has changed in the last few decades. While the enforcement of international issues may once have been undermined by differences in transnational institutions, the onset of globalisation has led to a greater willingness amongst states to cooperate with each other. It is suggested that this could be a positive development for, amongst other things, gradually tackling climate change, global poverty and the greater realisation of human rights. What is needed is a period of reflection of how far we (...)

An ‘existential’ shift? Technology and some questions for the legal profession.Kathrani Paresh - 2017 - Legal Ethics 20 (1):144-146.
Technology is changing the world in which we live and this includes the legal profession. This change has been remarked from many different standpoints. However, as technology is increasingly integrated into the fabric of legal practice, the very act of lawyering is likely to change and this will give rise to very important ethical questions.

Although the Refugee Convention 1951 generally provided that contracting states should recognise those who came within its definition as refugees, it did not prescribe how contracting states should determine this in order to enable them to balance this obligation with their national interests. However, evidence from the background and drafting of the Refugee Convention 1951 suggests that the provisions that a contracting states would implement in order to protect its interests would be commensurate with the human rights spirit of the (...)

Globalisation of Law: the Effect of Globalisation on the Domestic Interpretation of Law.Paresh Kathrani - 2009 - Jurisprudencija: Mokslo darbu žurnalas 116 (2):115-129.
The law consists of both internal and external rules, but in both cases they regulate the behaviour of the subjects towards each other. This can be viewed from a phenomenological perspective in the sense that people have a drive to make sense of their world, and the rules that are developed essentially enable them to relate to the world in this way. If anything interferes with this drive, then it causes peoples’ existential upset. That is why the state both enforces (...)

Social Contract Theory and the International Normative Order: A New Global Ethic?Paresh Kathrani - 2010 - Jurisprudencija: Mokslo darbu žurnalas 119 (1):97-109.
Although people establish norms that enable them to live together, some of these have to be coupled with a system of enforcement. This conforms to broad social contract theory and can also be applied to the international sphere. The international community is also based on a system of norms. However, unlike the domestic context, there is no overreaching authority to direct states on what they should do. Rather it is left to states themselves to police this framework. However, this has (...)

Japanese Childhood Vaccination Policy.Peter Doshi & Akira Akabayashi - 2010 - Cambridge Quarterly of Healthcare Ethics 19 (3):283-289.
The ethical tension in childhood vaccination policies is often framed as one of balancing the value of choice with the duty to protect. Because infectious diseases spread from person to person, unvaccinated children are usually described as putting others around them at risk, violating a perceived right to be protected from harm. Editors of Lancet Infectious Diseases recently argued against mandatory vaccination, reminding us that the resort to mandatory vaccination as a means of achieving high vaccination rates is still very (...)

Disclose Data Publicly, without Restriction.Peter Doshi & Tom Jefferson - 2017 - Journal of Law, Medicine and Ethics 45 (s2):42-45.
Ethical, evidence-informed decision making is undermined by the grave concerns that have emerged over the trustworthiness of clinical trials published in biomedical journals. The inescapable conclusion from this growing body of research is that what we see, even in the most highly regarded peer-reviewed journals, cannot be trusted at face value. Concerns of inaccurate, biased, and insufficient reporting of trials are impossible to resolve without access to underlying trial data. Access to such data, including things like clinical study reports—huge, unabridged, (...)

    Sequential Dependencies in Driving.Anup Doshi, Cuong Tran, Matthew H. Wilder, Michael C. Mozer & Mohan M. Trivedi - 2012 - Cognitive Science 36 (5):948-963.
The effect of recent experience on current behavior has been studied extensively in simple laboratory tasks. We explore the nature of sequential effects in the more naturalistic setting of automobile driving. Driving is a safety-critical task in which delayed response times may have severe consequences. Using a realistic driving simulator, we find significant sequential effects in pedal-press response times that depend on the history of recent stimuli and responses. Response times are slowed up to 100 ms in particular cases, a (...)

  33. Quality circles and human rights: tackling the universalism and cultural relativism divide. [REVIEW]Paresh Kathrani - 2012 - AI and Society 27 (3):369-375.
The implementation of international human rights law has traditionally been undermined by the dichotomy between universalism and cultural relativism. Some groups regard human rights as more reflective of other culture’s and are unwilling to subscribe to them. One response to this is to enable groups to take co-ownership of human rights. Quality Circles based on institutions and technology, and the collaboration they encourage, provide one such means for doing so. What is required is for states to facilitate rather than undermine (...)

Surveying the Indian research ethics committee response to the COVID‐19 pandemic.Yashashri C. Shetty, Sudha Ramalingam, Paresh Koli, Karthikeyan Shanmugam & Rajmohan Seetharaman - forthcoming - Developing World Bioethics.
Research ethics committees (RECs) have played a crucial role in expediting the review of research protocols amidst the COVID‐19 pandemic. To improve their performance and identify areas of enhancement, a multicentric study was conducted in India by the Forum for Ethical Review Committees in the Asian and Western Pacific Region (FERCAP). The study aimed to evaluate the preparedness of Indian RECs during the COVID‐19 outbreak while conducting protocol reviews and comprehend the challenges they encountered. After obtaining ethics committee approval, a (...)

The anomaly called psi: Recent research and criticism.K. Ramakrishna Rao & John Palmer - 1987 - Behavioral and Brain Sciences 10 (4):539-51.
Over the past hundred years, a number of scientific investigators claim to have adduced experimental evidence for phenomena information” seems to behave like a weak signal that has to compete for the information-processing resources of the organism, a reduction of ongoing sensorimotor activity may facilitate ESP detection. Such a meaningful convergence of results suggests that psi phenomena may represent a unitary, coherent process whose nature and compatibility with current physical theory have yet to be determined. The theoretical implications and potential (...)

Hume states that a miracle is a violation of the laws of nature which are proved to be true by common experience, and that the only sufficient testimony for a miracle would be testimony whose falsehood would be even more miraculous than the miracle itself. The primary objections to Hume's argument are that (1) it is tautological, since it presupposes the nonexistence of (...)

This article argues that current economic upheaval should be understood as a problem of domination, in two respects: the ‘dyadic’ domination of one actor by another, and the ‘structural’ domination of individuals by a diffuse, decentralized, but nevertheless human-made system. Such domination should be contested through specifically democratic political mobilization, through institutions and practices that expand the political agency of citizens themselves. The article advances this argument by synthesizing two traditions of political thought. It reconstructs radical democratic theory from the (...)
